The rules for using the Luminoise website and iPhone app, written to be read.
Effective
Agreement
These Terms are an agreement between you and Luminoise (“Luminoise”, “we”, “us”). They cover the website at luminoise.app (the “Site”) and the Luminoise iPhone app (the “App”). By visiting the Site or downloading, installing or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use them.
Who can use Luminoise
You must be at least 13 years old, or older if the law where you live sets a higher age for using online services without a parent’s permission. If you are under the age of majority where you live, you may use Luminoise only with a parent or guardian’s permission. The App requires iOS 18 or later.
Your license
The App is licensed to you, not sold. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices you own or control, for your own non-commercial use, under these Terms and the Apple terms below. We grant you a similar license to view the Site for personal use. We keep every right we do not expressly give you.
Using Luminoise
You agree not to:
copy, modify, distribute, sell, rent or sublicense the App or the Site, except as these Terms allow;
reverse engineer, decompile or try to extract source code, models or assets, except where the law gives you that right despite this restriction;
extract, scrape, download or redistribute music, quotes, visuals or other content, or use any of it to train, tune or test machine learning or AI models;
circumvent or interfere with the App’s security, access controls or technical protections;
use Luminoise to break the law, infringe anyone’s rights, or harm or disrupt others or our services;
present Luminoise or its content as medical treatment, or use it in a way that suggests we endorse you or your product.
Music and content
Music, recordings, compositions, quotes, visuals, text and other content in Luminoise belong to us or to our licensors and are protected by copyright and other laws. Quotations shown in the App remain the work of their authors. Using Luminoise gives you the right to listen and read for yourself, not to own or reuse any of it.
Not medical advice
Luminoise is neuroscience-informed, meaning its sound design draws on published research about music, attention, mood and stress. It has not been tested in its own clinical trials, and it is not a medical device. It does not diagnose, treat, cure or prevent anxiety, depression, ADHD or any other condition, and it is not a substitute for professional advice. Results vary from person to person, and we do not promise any particular effect on your focus, mood or brain activity.
If you are worried about your health or your mental health, talk to a doctor or other qualified professional. If you are in crisis or in danger, contact your local emergency services.
Listening safely
Keep the volume at a level that does not harm your hearing. Do not use Luminoise, headphones or Lock In in situations where reduced awareness of your surroundings could be dangerous, such as while driving, cycling or crossing the road. Stop using the App and seek advice if it causes you discomfort.
Paid features
At the time of writing the App can be used without an account. If we offer paid features or subscriptions, the price, billing period, renewal and cancellation terms will be shown before you buy. Purchases are processed by Apple through your Apple Account, and Apple’s terms govern payment, cancellation and refunds. We do not receive your payment card details.
Feedback
If you send us ideas or suggestions, you agree that we may use them without obligation or payment to you. We will not use your name in connection with them without asking.
Third-party links
The Site links to published research and to other websites we do not control. We are not responsible for their content or practices, and linking is not an endorsement by them of Luminoise or by us of them beyond citing their published work.
Intellectual property
Luminoise, the Luminoise wordmark and logo, and the look and feel of the Site and App are ours. Certain methods and features of Luminoise are patent pending. See the Legal page for notices, trademarks and third-party credits. If you believe content in Luminoise infringes your copyright, follow the process on that page.
Changes and ending use
We may update the Site and App, add or remove features, and update these Terms. When we make a material change to the Terms, we will change the date at the top of this page and, where appropriate, tell you in the App or on the Site. Using Luminoise after a change takes effect means you accept it. You can stop using Luminoise at any time by deleting the App. We may suspend or end your access if you breach these Terms or if we need to for legal or security reasons. Sections that by their nature should survive, such as those on intellectual property, disclaimers and liability, will.
Disclaimers
To the fullest extent the law allows, Luminoise, the Site and the App are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that the service will be uninterrupted or error-free. Some places do not allow certain disclaimers, so some of this may not apply to you.
Limit of liability
To the fullest extent the law allows, Luminoise is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Site or App. Our total liability for any claim relating to Luminoise is limited to the amount you paid us for the App in the 12 months before the claim, or US$50 if you paid nothing.
Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or your rights as a consumer under mandatory local law.
Apple terms
This applies to the App as downloaded from the Apple App Store.
These Terms are between you and Luminoise only, not Apple. Luminoise, not Apple, is responsible for the App and its content.
The license is limited to a non-transferable license to use the App on any Apple-branded products you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
Luminoise is solely responsible for maintenance and support of the App. Apple has no obligation to provide them.
If the App fails to meet any applicable warranty, you may tell Apple, and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the App.
Luminoise, not Apple, is responsible for addressing your claims or those of any third party relating to the App, including product liability claims, claims that the App fails to meet legal requirements, and consumer protection or privacy claims.
If a third party claims the App infringes its intellectual property, Luminoise, not Apple, is solely responsible for investigating, defending and resolving the claim.
You represent that you are not located in a country subject to a U.S. government embargo or designated a “terrorist-supporting” country, and that you are not on any U.S. government list of prohibited or restricted parties.
You must comply with applicable third-party terms, such as your wireless provider’s data terms, when using the App.
Apple and its subsidiaries are third-party beneficiaries of these Terms. On your acceptance, Apple has the right to enforce them against you as a third-party beneficiary.
Governing law
These Terms are governed by the laws of the jurisdiction in which Luminoise is established, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory consumer laws of the place you live, and you may bring a claim in the courts there if those laws give you that right. Before starting a formal dispute, please write to us at legal@luminoise.app and give us 30 days to try to resolve it.
General
These Terms and the Privacy Policy are the whole agreement between you and us about Luminoise. If a part is found unenforceable, the rest stays in effect. Not enforcing a right is not giving it up. You may not transfer your rights under these Terms; we may transfer ours as part of a merger, acquisition or sale of assets.
